Consumer arbitration is an out-of-court dispute resolution procedure between consumers and entrepreneurs. Its purpose is to solve the problems that arise between the two parties without having to go to court.
Disputes that may arise between the consumer and a company can be resolved through the arbitration system of consumption, an out-of-court service, free, simple, fast (the files are processed in a maximum of six months from the admission to the application) and voluntary.
An arbitral school studies the case and issues a mandatory award that resolves the discussion raised.
If the dispute is not resolved in the pre-mediation phase and the company is adhering to the arbitration system, an arbitral body (tripartite or single-person) examines the case and issues a mandatory award resolving the discussion raised.
Consumer arbitration is regulated by Law 60/2003, of December 23, Arbitration, and Royal Decree 231/2008 of February 15, regulating the Arbitration System of Consumers, as amended by Royal Decree 863/2009, of May 14.
